    Allahabad High Court Blames ‘Rape Victim’ for Incident, Accused Granted Bail

    The Allahabad High Court granted bail to a rape accused while holding the woman partly responsible for the incident. The student from a major Noida university had gone to a bar in Delhi with friends.

    Allahabad High Court Blames ‘Rape Victim’ for Incident, Accused Granted Bail

    The Allahabad High Court held the woman responsible in a rape case and granted bail to the accused. Actually this case is of September 2024. According to the case, a university student had alleged that a man had raped her in a drunken state. However, the accused argued that the woman herself had agreed to go with him and the relationship was consensual. After this, the court told the victim that you are responsible for this incident.


    What is the whole matter?


    The woman was a student of a big university in Noida. She had gone to a bar in Hauz Khas, Delhi with her three friends. Here she met some acquaintances and the accused was also included in this. In the complaint given by the woman to the police, she told that after drinking alcohol, she was intoxicated and the accused was hovering around her. The victim said that the accused was constantly asking her to come with him. After asking several times, she agreed to go with the accused to rest. The woman has claimed in the complaint that the accused was touching her in an objectionable manner on the way and took her to a relative's flat in Gurgaon and raped her.


    According to the report of law website Bar and Bench, in the argument given against the woman, the accused said that the woman needed help and she herself agreed to rest with him at home. The accused claimed that there was no rape but the relationship was consensual.

    Know what the court said


    During the hearing, Allahabad High Court said, "We believe that even if the victim's allegations are considered correct, it can also be concluded that she herself invited trouble and she is responsible for it. The victim has also said the same in her statement. Her hymen is broken in her medical examination, but the doctor has not talked about sexual violence."


    The court said that we believe that after hearing all the facts, evidence and arguments, the applicant can be granted bail. In such a situation, the bail application is accepted. After the court's decision, the accused has got bail.
